DAYTRADE PREDICTOR TERMS

1. Service

These Terms govern access to DayTrade Predictor, including its Discord application, automated market information, trend analysis, indicators, watchlists, predictive scoring, alerts, and related services provided by ElJeffe_813 Development ("Provider," "we," "us," or "our"). By purchasing, accessing, or using the Service, you agree to these Terms.

2. Not Financial Advice

ElJeffe_813 Development is not acting as your financial adviser, investment adviser, broker, fiduciary, or securities dealer. You are solely responsible for evaluating Service information and for every trading or investment decision you make.

3. Investment Risk

Trading and investing involve substantial risk, including loss of some or all invested capital. Predictions, indicators, confidence scores, trends, alerts, and historical information are not guarantees of future performance. Market conditions can change rapidly and Service information may be inaccurate, incomplete, delayed, or outdated. Never trade or invest money you cannot afford to lose.

4. Subscription

Paid access is currently offered at $9.99 USD per month unless another price is clearly disclosed before purchase. Subscriptions are recurring and may automatically renew until canceled through the platform where purchased. Applicable taxes, platform charges, billing procedures, and payment processing may be handled by Discord or another authorized payment provider. Pricing may change subject to applicable law and platform rules.

5. Cancellation and Refunds

Subscribers may cancel through the applicable billing platform. Cancellation prevents future renewals but may not immediately end an already-paid subscription period. Except where required by law or mandatory platform policy, payments are generally non-refundable once the applicable subscription period begins. Nothing here limits rights that cannot legally be waived.

6. Complimentary Access

ElJeffe_813 Development may grant selected users complimentary or Authorized Free access. Complimentary access does not create an entitlement to continued access and may be modified or withdrawn at our discretion.

7. Discord Accounts and Access

Access may be associated with your Discord account, application entitlement, server membership, or designated Discord role. Individual access may not be sold, transferred, or shared. Attempts to circumvent subscription controls or obtain unauthorized access may result in suspension or termination.

8. Acceptable Use

You may not misuse the Service, interfere with its operation, attempt unauthorized access, exploit vulnerabilities, fraudulently obtain access, or use it unlawfully. You may not systematically scrape, reproduce, redistribute, republish, resell, sublicense, or commercially distribute DayTrade Predictor alerts, analyses, proprietary outputs, or protected content without written authorization.

9. Third-Party Market Data

The Service may rely on exchanges, market-data services, APIs, websites, or other third parties. ElJeffe_813 Development does not guarantee third-party accuracy, completeness, timeliness, availability, or continued availability. Data delays, API failures, network interruptions, maintenance, software errors, and third-party outages may affect the Service.

10. Service Availability

We may update, modify, suspend, restrict, or discontinue portions of the Service as reasonably necessary for maintenance, security, development, legal compliance, or operations. Continuous or uninterrupted availability is not guaranteed.

11. No Guarantee of Results

No representation is made that DayTrade Predictor will generate profits, prevent losses, identify every opportunity, or outperform any strategy or benchmark. Users remain solely responsible for deciding whether, when, and how to enter, modify, or exit any position.

12. Intellectual Property

DayTrade Predictor, its software, branding, proprietary analysis formats, original content, and related intellectual property are owned by or licensed to ElJeffe_813 Development except where otherwise stated. A subscription grants a limited, personal, revocable right to use the Service and does not transfer ownership.

13. Suspension and Termination

Access may be suspended or terminated for material violations, fraud, unauthorized redistribution, attempts to bypass access controls, abuse, or conduct threatening Service security or operation. Rights and obligations that by their nature should survive termination remain in effect.

14. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available." ElJeffe_813 Development disclaims warranties not expressly provided here, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement where legally permitted.

15. Limitation of Liability

To the maximum extent permitted by law, ElJeffe_813 Development will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Service, including trading or investment losses, lost profits, lost opportunities, or losses from reliance on Service outputs. Nothing excludes liability that cannot lawfully be excluded.

16. Changes

These Terms may be updated as the Service, laws, or business practices change. Material changes will be communicated or published through an appropriate Service channel where reasonably required. Continued use after an effective change constitutes acceptance to the extent permitted by law.

17. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

18. Severability

If any provision is invalid or unenforceable, the remaining provisions remain effective to the maximum extent permitted by law.

19. Entire Agreement

These Terms, the applicable Privacy Policy, and any additional terms presented at purchase constitute the agreement governing DayTrade Predictor.
